Nancy Givren v. MMG Insurance Company

The company nonrenewed the homeowners policy, stating that the risk did not meet homeowner program eligibility due to the number of animals on the residence premises including four horses.

Held: For the insured. MMG had accepted the risk with three horses in 2006, but determined the one additional horse represented too great an exposure. The company’s guidelines, however, do not specify a number of horses as a cut-off for eligibility, but consider each risk individually. The testimony indicated that in fact the insured’s large barn was the issue, and that the policy would not have been renewed even in the absence of the additional horse. As the barn was not included in the stated reason for nonrenewal, and the company did not demonstrate why the addition of one more horse was a good faith reason relating to the insurability of this particular property, the nonrenewal was denied.
