ORDER |
The Presiding Officer’s June 6, 2005 Notice of Pending Proceeding and Pre-hearing Conference set a deadline of 3:00 p.m. on June 23, 2005 for submitting applications for intervention and a deadline of 3:00 p.m. on June 30, 2005 for submitting statements in opposition to such applications. The Presiding Officer did not receive any such filings. The parties to this proceeding currently are Project Staffing, Inc., One Source Preferred, Inc., Special Teams, Inc., Maine Employers Mutual Insurance Company, and National Council on Compensation Insurance. At the time of such notice, the Presiding Officer had not set dates for the parties to complete discovery and for the hearing. After a conference with the parties, on June 16, 2005 the Presiding Officer issued an order which, among other topics, set this matter for hearing on November 15, 2005.
Inasmuch as the hearing will not take place until November 15, 2005, the Presiding Officer ORDERS that:
Persons wishing to intervene as parties in this proceeding shall file their applications in writing with the Presiding Officer no later than 3:00 p.m. on August 12, 2005, and shall simultaneously serve a copy of the intervention application on all parties at the name and address identified at the end of this Notice.
An applicant claiming intervention as of right pursuant to 5 M.R.S.A. § 9054(1) shall include in the application a statement either explaining how the applicant is or may be, or is a member of a class that is or may be, substantially and directly affected by the proceeding or identifying the applicant as an agency of federal, state, or local government. Applications for permissive intervention pursuant to 5 M.R.S.A. § 9054(2) shall contain a statement explaining and substantiating the applicant’s interest in the proceeding. The Presiding Officer will not grant late applications without a showing of good cause.
Any party that opposes an application for intervention shall file a statement in opposition to the application with the Presiding Officer by 3:00 p.m. on August 19, 2005, and shall simultaneously serve a copy of the statement in opposition on all parties in the same manner as the service of an application for intervention.
The Presiding Officer’s June 6, 2005 Notice of Pending Proceeding and Pre-hearing Conference and June 16, 2005 Scheduling Order and Notice of Hearing otherwise remain in effect. Persons interested in reading such orders may view them at the Bureau of Insurance website, www.maine.gov/insurance.
